Abstract In some strategic emerging industries,it exists the issue of “patent fragment” which means the number of patents continue increasing, the patent concentration degree decreases，patents are shared by many holders，and they enjoy exclusive rights but not rights of using all patents. This issue will hinder innovation，increase transaction costs，limit competition and reduce social welfare and so on. According to literature，Chinese LED industry patent concentration degree started decreasing, and the trend of “patent fragment” is existing in Chinese LED industry, the reason is unknown. And such, this empirical study aims to reveal the reason about Chinese LED industry “patent fragment” shaped by PLS. The result showed the number of standard and the number of IPC have most significant to the forming of Chinese LED industry patents；the number of patentees, the number of cooperated patentees, the number of cooperated patentand the number of inventors impact on “patent fragment”. Some suggestions about solving the issue of “patent fragment” are given.
